1. Agreement to Terms
By creating an account or using PhysioFlow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Description of Service
PhysioFlow is a cloud-based practice management platform for physiotherapy and veterinary practices. The Service includes client management, appointment scheduling, clinical notes, reporting, invoicing, and related features.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorised use of your account.
- You must be at least 18 years old and legally able to enter into a binding agreement.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload or transmit any content that infringes third-party intellectual property rights.
- Attempt to gain unauthorised access to other accounts, systems, or networks connected to the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service to store data that is not related to your legitimate practice management activities.
5. Data Ownership and Responsibility
- Your data: you retain full ownership of all data you enter into the Service. We do not claim any intellectual property rights over your content.
- Data controller: as the Organisation using PhysioFlow, you are the data controller for all client and patient data entered into the platform. You are responsible for ensuring you have a lawful basis to process this data.
- Health data: you acknowledge that the Service is used to process special category data (health data) under UK GDPR. You are responsible for obtaining appropriate consent from your clients/patients where required.
- Accuracy: you are responsible for the accuracy and completeness of data you enter into the Service.
6. Subscriptions and Payment
- The Service is offered on a subscription basis. Pricing and plan details are available on our website.
- New accounts receive a free trial period. After the trial, a paid subscription is required to continue using the Service.
- Subscriptions renew automatically. You may cancel at any time; cancellation takes effect at the end of the current billing period.
- All fees are quoted in GBP and are exclusive of VAT unless stated otherwise.
- We reserve the right to change pricing with 30 days' notice.
7. Service Availability
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will endeavour to provide reasonable notice of planned downtime.
8. Intellectual Property
The Service, including its design, code, features, and documentation, is owned by PhysioFlow and protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your practice management needs.
9. Limitation of Liability
- The Service is provided "as is" without warranties of any kind, whether express or implied.
- PhysioFlow is not liable for any clinical decisions made using data stored in the Service. The Service is a management tool, not a medical device.
- To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
10. Termination
- You may terminate your account at any time through the account settings.
- We may suspend or terminate your account if you breach these Terms, with notice where practicable.
- Upon termination, you may request an export of your data within 30 days. After 90 days, your data will be deleted or anonymised in accordance with our data retention policy, subject to legal obligations.
11. Data Processing Agreement
Where PhysioFlow acts as a data processor on your behalf, a Data Processing Agreement (DPA) governs our processing of personal data. The DPA is available on request and forms part of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the Service and request your acceptance of the updated Terms before you can continue using the platform. Continued use after acceptance constitutes agreement to the revised Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
